What is General Product Safety Regulation (GPSR) EU/2023/988?

The General Product Safety Regulation (GPSR) EU/2023/988 uses the EU general product safety legal framework to address new challenges from digitalization, whilst ensuring consumer products on the EU markets are safe. The GPSR replaces the current General Product Safety Directive (2001/95/EC) as of 13th December 2024.

General Product Safety Directive GSPD

Unlike many product directives, the GPSD directive (2001/95/EC) does not require the use of CE marking but uses many of the same principles, such as the option to use harmonized standards to provide a presumption of conformity to the safety requirements of the directive.

General Product Safety Regulation

From December 2024 the General Product Safety Regulation (GPSR) EU/2023/988 will take effect within the EU product safety legal framework replacing the current General Product Safety Directive (2001/95/EC). This regulation requires that all consumer products entering the EU markets are safe, the regulation establishes specific obligations for businesses to ensure this.

Testing for the General Product Safety Directive (2001/95/EC) and GPSR (EU/2023/988)

We provide objective, third-party testing, and support to help give you the confidence that you are placing safe, compliant products in your chosen market. We can also help to identify risks associated with your product, produce test plans, or choose appropriate test standards to avoid unnecessary compliance penalties.

General product safety guidance

Because of the broad scope of the directive and regulations, it can be difficult to understand how it applies to your product and how to demonstrate that your product is ‘safe’. Through our advisory services, we provide guidance, advice, and support in the initial stages of your product development so that you can incorporate the appropriate safety principles into your product's design reducing significant time to market.

What is the difference between GPSD and GPSR?

The difference between GPSD and GPSR is that the new EU General Product Safety Regulation EU/2023/988 offers future-proofed product safety rules for consumer protection against non-food products sold offline or online.

New additions set out by the European Commission GPSR guidance offer clearer guidelines for compliance than the GPSD Directive and include the following updates:

  • Product safety obligations for both economic operators and online marketplaces such as Amazon.
  • Reinforced product traceability requirements
  • Accident reporting to authorities by businesses
  • Reinforced market surveillance rules
  • Rules on handling product recalls, mandatory recall notice template, and right to remedy for consumers
  • Improved guidance
